On October 30, 2026, a federal appeals court rejected the Trump administration’s attempt to block California from counting more than 20,000 mail ballots flagged by the Justice Department for suspected noncitizen voters. The 9th Circuit Court of Appeals denied the DOJ's emergency request on October 30, leaving the decision in place. On November 1, the court criticized the DOJ for failing to comply with a deadline set earlier by Judge David O. Carter, a Clinton appointee, who had previously dismissed the DOJ’s lawsuit and ruled against halting ballot counting. Despite this, Trump's Justice Department continued to resist providing voter information lists demanded by the court, arguing that complying would be akin to engaging in a "fishing expedition." On November 2, Chief U.S. District Judge James Boasberg ordered the Trump administration to stop demanding California officials set aside these ballots ahead of the midterms, citing constitutional overreach.
