Kally Sahota, senior solicitor and director of Sahota & Sahota Solicitors, exclusively tells Page Six that she expects the comedian, 51, to receive a significant custodial sentence following Thursday’s guilty verdict.

“My estimate, based on the convictions and what is publicly known, would be in the region of eight or nine years, although the final sentence is for the judge to decide,” she says.

Although a life sentence is legally possible for rape in England and Wales, Sahota says she would not expect Brand to receive one.

The sentencing guidelines for rape provide a range of four to 19 years in custody, she explains.

The judge must also determine how to sentence Brand for his three sexual assault convictions and whether those sentences should run concurrently with his rape sentence or consecutively, meaning one after another.

“The court then applies the principle of ‘totality’ to ensure the overall sentence reflects all the offending and is proportionate,” Sahota explains.

The lawyer’s estimate comes after a jury at London’s Southwark Crown Court found Brand guilty of one count of rape and three counts of sexual assault involving four women.

If Brand receives a standard fixed-term sentence of at least four years for rape, he would normally be required to serve two-thirds of his sentence behind bars before being released on licence, according to Sahota.

That means an eight- to nine-year sentence could translate to roughly five years and four months to six years in prison, with the remainder served under supervision in the community.

Release on licence is not the same as being completely free, as Brand would have to follow conditions and could be sent back to prison if he breached them.
Sahota also addressed what life behind bars could look like for the high-profile entertainer, explaining that there is no equivalent of America’s separate white-collar prison system in England and Wales.

Sahota says those allegations are separate from the convictions handed down Thursday, and prosecutors must decide whether there is enough evidence to bring further charges and whether a prosecution is in the public interest.
If additional charges are brought, prosecutors could ask a judge to allow Brand’s current convictions to be introduced as “bad character” evidence in a subsequent trial.
That is not automatic, however, as a judge would have to determine whether the evidence is admissible and whether it would be fair to use it.

Any future jury would still have to decide the new allegations based on the evidence presented in that case.

Brand’s legal troubles began making headlines in September 2023, when The Sunday Times and Channel 4’s “Dispatches” published investigations detailing allegations of sexual misconduct by multiple women.
