Marlene Garbowski from New Jersey is suing Southern Hills Hospital in Las Vegas after hospital staff mistakenly told her that her son, Geoffrey, had died. The incident occurred in November 2024 when Garbowski called the hospital to request medical records needed for her son's application for Social Security benefits. Staff informed her that they could not release the records because he was listed as a "deceased patient." Garbowski suffered severe emotional distress and believed her son was dead for about three days before learning he was still alive. She claims she was unable to leave her bed and experienced extreme grief, leading her to take anti-anxiety medication for the first time in her life. The lawsuit filed in Clark County District Court asserts that Southern Hills Hospital failed its duty of care by providing inaccurate information, causing Garbowski significant emotional harm.
