In March 2023, the Director of Public Prosecutions in Queensland applied to the Court of Appeal (COA) for a retrial of a man who had been previously acquitted of murder. The alleged murder took place in Logan in 2009 and involved new evidence, including two confessions. Despite objections from the defendant's lawyers, arguing that these confessions were unreliable and inconsistent with previous statements, the COA granted the application on Tuesday, overturning the earlier acquittal. This is the first time Queensland has ordered a retrial under its double jeopardy laws, which prohibit prosecuting someone twice for the same crime unless new evidence emerges. The case marks a significant legal precedent in Queensland's justice system.
