On October 31, 2026, an analysis by two UCLA data scientists found that more than 40% of the names on the Department of Justice list of alleged noncitizen voters in California are not present on the state’s voter rolls. The list, containing over 20,930 names, was provided to election officials by the Trump administration and has been challenged as unconstitutional by multiple judges. The analysis also revealed that thousands of U.S. citizens appear on the government's list as ineligible voters, raising significant concerns about potential voting rights violations. This finding comes amid the final days before critical midterm elections in the United States, where control over key state and federal offices is at stake.
The Trump administration’s list, delivered to California in early October, had suggested that as many as 20,930 “likely non-citizens” were registered on the state’s voter rolls.
The lawsuit is unfolding in the final days before Tuesday’s pivotal midterm elections, which will decide which party controls the US Congress, as well as key state and local offices. Trump has expressed fear that, if his Republican Party loses its majorities in the two chambers of Congress, he could be impeached.
Critics, including California’s Democratic Governor Gavin Newsom, have cited that fact in their rebuttal to Trump’s lawsuit. All 50 states already prohibit non-citizen voting in federal elections and undertake measures to prevent voter fraud, which is considered exceedingly rare.
Such errors have raised concerns that eligible citizens would see their votes denied
